GENERAL TERMS AND CONDITIONS
All prices are in Australian dollars (AUD),including GST, and are subject to change without notice.
Tour type and times can be affected by tidal variations; are weather dependent and approximate and subject to change without notice. The type of vessel described in a tour is a guide only. Vessels may be substituted from time to time; maximum passenger numbers for any tour may vary from time to time. Tour itineraries may vary from those published.
Please advise office staff and crew at time of tour if you do not want your image used on The Operator’s social media pages.
The Operator reserves the right to cancel or alter tours without notice. Cancellations may be on the day of the tour, and can be due to weather conditions, mechanical issues, late passenger cancellations affecting minimum numbers, low passenger numbers, safety of guests or any other unforeseen event. Any additional expense will be at the passenger's cost.
Minimum numbers are required for each tour to commence. In the event of minimum tour numbers preventing tour departure, The Operator will endeavour to transfer the passenger to another tour date where space is available and tours are confirmed. If a transfer is not possible, a full refund of the tour cost will be given.
The Operator reserves the right to refuse entry into the water to any passenger whom the skipper believes does not have the required swimming ability, is a potential danger to either themselves, other guests or crew, or who has transgressed tour rules and conditions (as advised prior to tour departure).
The Operator does not guarantee wildlife sightings or interactions on any tour at any time. Wildlife is, by its very nature, 'wild' and marine life exists without constraints on their behaviour, therefore no guarantee of sightings can be provided.
The Operator will not allow entry into the water of any passenger with any animal if human presence in the water will disturb or alter marine life natural behaviour.
The Operator is not responsible for loss or damage of passenger luggage, personal effects or equipment. The Operator is not responsible for injury or death of any passenger during embarkation, carriage or disembarkation from any vehicle or vessel.
The Operator strongly recommends passengers obtain travel insurance prior to undertaking any tour.
It is advised that passengers wishing to participate in Marine Ecotour, Whale Shark tours and Humpback Whale tours should be competent swimmers.
COVID/GENERAL CANCELLATION POLICY
The Operator advises that you provide enough time in Coral Bay to allow for tour cancellations due to unforeseen circumstances.
Should the booking be cancelled by the passenger for any reason (final payment not received, illness, deposit not received in a timely manner) the original tour costs may no longer apply.
In the event of tour cancellation by the passenger, the following terms and conditions apply:
- Once a booking is confirmed a cancellation fee of 25% of total tour cost applies
- Passenger Provides less than 7 days' notice - 100% of total tour cost applies
In the event a passenger wishes to transfer their booking to another date through no fault of The Operator the following terms and conditions apply;
- Passenger provides 2 - 4 days’ notice - 25% of total tour cost applies
- Passenger provides less than 24 hrs notice - 50% of total tour cost applies
Due to WA government mandates, all patrons over the age of 16 years old are required to be fully vaccinated against COVID19, unless medically exempt. To assist us in achieving this mandated condition, The Operator requires that all guests please provide proof of vaccination to a member of our office staff prior to your tour.
If a tour is cancelled due to a change in government regulations, as a directive for an external governing body, as a matter of public safety or in extenuating circumstances such as COVID19 health crisis, The Operator reserves the right to retain 25% of the total tour cost as an administration fee.
All Gift Vouchers are non-refundable and are valid for two years from the purchase date.
CHILD / INFANT POLICY
Child passengers are defined as being an age of 6 years old to 16 years old. 17 year old passengers are defined as adults. Family prices refer to 2 adults and 2 children between 6 and 16 years old. Children 5 years and under at the time of tour are Free of Charge (FOC) EXCEPT when swimming with whale sharks or humpback whales. In these cases, the child will be charged at child prices. All minors must be accompanied by parents or guardians AT ALL TIMES who are entirely responsible for their care. Children must not be left unattended by parents or guardians on any tour boat or whilst in the water at any time.
All infants are allowed to join the reef snorkels on all tours with no extra charge.
Infants who want to swim with Whale Sharks, Manta Rays and Humpback Whales will be charged as children. Please book as a child instead of infant to avoid missing out as these tours have very limited seats.
CHILD SUPERVISION POLICY
An adult must accompany any passenger under the age of 15 at all times, this includes all in-water activities. Children under the age of 15 are not permitted to be left on the vessel unaccompanied, this includes when an in-water activity is taking place. Adults are to take turns in the water if a minor wishes to remain on-board.
WHALE SHARK SAFARI - NO SIGHTING POLICY
The Operator does not offer non-sighting repeat vouchers or refunds for this tour.
HUMPBACK WHALE SAFARI - NO SWIM POLICY
In the event that an in-water interaction is not possible on the day of the tour, Interaction swimmers will be refunded from the interaction price to the ‘Wildlife swimmer’ price. The Operator does not offer non-sighting repeat vouchers for this tour.
Please note no refund will be offered if no sighting while in the water occurs.
Swim with Whale Shark is also considered as in-water interaction and no refund will be offered.
SAFETY PROCEDURES 2022
- Due to WA government mandates, all patrons over the age of 16 years old are required to be fully vaccinated against COVID19, unless medically exempt. To assist us in achieving this mandated condition, The Operator requires that all guests please provide proof of vaccination to a member of our office staff prior to your tour.
- All The Operator staff have completed the AHA COVID-19 Hygiene Course and all tours will have a registered Hygiene Officer onboard
- Crew safety briefings will outline the necessary procedures and practices on the tour vessel which guests must adhere to
- To minimise the risk of transmission through the use of shared equipment, guests are encouraged to either bring their own masks and snorkels, wetsuits and other personal gear, or purchase new, unopened equipment from the office.
- Complimentary hand sanitiser will be available at our office and at sanitising stations throughout our vessels.
- Crew will be frequently cleaning and sanitising all regular contact surfaces during the tours.
- Various signs and information posters are displayed at our office and on tour vessels to remind everyone of the increased procedures and safety precautions.
